This policy explains how Date of Earth collects, holds, uses, and shares personal information when you visit our website, create a personalised print, contact us, or place an order.

This Privacy Policy applies to dateofearth.com and related services operated by Date of Earth from Sydney, New South Wales, Australia (together, the “Site”).

We do not sell personal information for money. Depending on where you live, some disclosures for targeted advertising may be treated as a “sale” or “sharing” of personal information. You may opt out of targeted advertising using the controls described below or by contacting us.

Personal information we collect

When you visit the Site, we may automatically collect information about your device and use of the Site, including your web browser, IP address, approximate location, time zone, device identifiers, and some of the cookies installed on your device. We may also collect information about the pages and products you view, the website or search terms that referred you to us, and how you interact with the Site. We call this Device Information.

How Device Information is collected

  • Cookies are small data files placed on your device or computer. They often include an anonymous unique identifier. You can learn more about cookies and how to manage them at All About Cookies.
  • Log files record actions on the Site and may collect your IP address, browser type, internet service provider, referring and exit pages, and date and time stamps.
  • Web beacons, tags, and pixels are electronic files that record information about how you browse and interact with the Site and our communications.

Order and design information

When you place or attempt to place an order, we may collect your name, email address, phone number, billing and shipping addresses, country, order details, and payment-related information. Payments may be processed by a specialist payment provider, such as Stripe; we do not ordinarily receive or store your complete card number.

Because each Date of Earth print is personalised, we also collect the date, location, coordinates, message, design selections, uploaded or generated artwork, preview, and other details you provide for the print. Please only provide information about another person when you have their permission or are otherwise authorised to do so.

Communications and marketing information

We collect information you provide when you contact us, request support, submit feedback, subscribe to email or SMS marketing, enter a promotion, or otherwise communicate with us. This may include records of delivery, opens, clicks, and your marketing preferences.

We refer to Device Information, order and design information, communications, and marketing information together as Personal Information where the information identifies you or can reasonably be linked to you.

How we use your personal information

  • To create and fulfil orders: to produce your personalised artwork, process payment, arrange printing and delivery, provide order updates, and handle returns, refunds, and support.
  • To communicate with you: to respond to questions, send service messages, and keep records of our interactions.
  • To operate and improve the Site: to understand how people browse and use the Site, troubleshoot issues, test features, improve performance, and measure our marketing.
  • To keep Date of Earth secure: to detect, investigate, and prevent fraud, misuse, security incidents, and other unlawful activity.
  • To market our products: to send marketing you have requested or that is otherwise permitted by law, personalise content and advertising, and measure campaign performance. You can opt out at any time.
  • To meet legal obligations: to maintain tax and business records, respond to lawful requests, enforce our terms, and protect our rights and those of others.

Cookies and extended identity tracking

We use first-party cookies and similar technologies to remember your preferences, keep the Site working, understand usage patterns, and personalise content and marketing. First-party cookies are set by the domain you are visiting.

First-party identifiers and Klaviyo

Where enabled, our email and marketing platform, Klaviyo, may use first-party identifiers to recognise a returning device and correlate interactions across sessions. This can extend recognition for up to a year, including after an earlier cookie expires, and may associate a cookie identifier with a hashed or persistent identifier such as an email address you provided.

This allows us to link earlier interactions with a later visit for analytics, relevant messages, and personalised marketing. If required by applicable law, we will ask for consent before placing non-essential cookies or enabling extended identity tracking. You can also restrict or delete cookies through your browser settings, although parts of the Site may not work as intended.

Sharing your personal information

We share Personal Information only as reasonably necessary for the purposes described in this policy. Recipients may include:

  • payment processors, fraud prevention providers, and financial institutions;
  • printing, framing, fulfilment, warehousing, and delivery partners;
  • website hosting, data storage, customer support, email, SMS, analytics, and marketing providers;
  • professional advisers, insurers, auditors, and business service providers; and
  • regulators, courts, law enforcement, or other parties where required or authorised by law, or where necessary to protect our rights, customers, or the public.

We may also disclose information as part of a proposed or completed merger, financing, acquisition, sale, or transfer of all or part of our business, subject to appropriate confidentiality arrangements.

We may use Google Analytics to help us understand how visitors use the Site. You can read Google’s Privacy Policy and install the Google Analytics Opt-out Browser Add-on.

Overseas disclosure

Date of Earth operates from Australia, but some of our service providers and fulfilment partners operate or store information overseas. Depending on the services used for your order, Personal Information may be disclosed to recipients in countries including the United States, Canada, the United Kingdom, and member states of the European Union or European Economic Area, as well as the country where your order is printed or delivered.

Where Australian privacy law applies, we take reasonable steps in the circumstances to ensure overseas recipients handle Personal Information consistently with the Australian Privacy Principles, subject to applicable exceptions.

Behavioural advertising

We may use Personal Information to provide targeted advertisements or marketing communications we believe may be relevant to you. You can learn how targeted advertising works through the Network Advertising Initiative.

You can manage targeted advertising preferences using these services:

  • Microsoft advertising settings
  • Digital Advertising Alliance opt-out portal

You may also contact us to object to the use or disclosure of your Personal Information for direct marketing. We will stop using it for that purpose where required by law.

Do Not Track

Because there is no consistent industry standard for responding to browser “Do Not Track” signals, we do not currently alter our Site’s data collection practices when we receive one. Where required by applicable law, we will recognise supported universal opt-out signals. You can also use browser controls, advertising preference tools, or contact us to exercise available choices.

Your rights

Australia

You may ask us for access to Personal Information we hold about you or ask us to correct information that is inaccurate, out of date, incomplete, irrelevant, or misleading. You may also ask us to delete or de-identify information, although we may need to retain some records where required or permitted by law.

To make a request, email privacy@dateofearth.com. We may need to verify your identity before completing it. We will respond within a reasonable period and, if we refuse a request, explain the reasons where required by law.

Other regions

Depending on where you live, you may have additional rights to access, correct, delete, restrict, object to, or receive a portable copy of your Personal Information, withdraw consent, or appeal a decision. European Economic Area and United Kingdom residents may also complain to their local data protection authority. We process information as needed to fulfil our contract with you, comply with legal obligations, pursue legitimate business interests, or based on consent, as applicable.

Data retention

We retain order and design information for as long as reasonably necessary to fulfil your order, provide support and reprints, maintain business and tax records, resolve disputes, prevent fraud, and comply with legal obligations. Other information is retained for as long as needed for the purpose for which it was collected.

When Personal Information is no longer required, we take reasonable steps to destroy or de-identify it, unless we are required or permitted to retain it. You may ask us to delete information, subject to these obligations.

Security

We use reasonable technical and organisational safeguards designed to protect Personal Information against misuse, interference, loss, and unauthorised access, modification, or disclosure. No internet transmission or storage system is completely secure, so we cannot guarantee absolute security.

SMS marketing

If you provide your phone number and opt in to SMS marketing, you consent to receive marketing, promotional, or informational SMS and MMS messages from Date of Earth at that number. Consent is not a condition of purchase.

SMS data collection and use

We collect your phone number and may collect message delivery status, replies, and engagement information. We use this information to operate and improve our messaging service, tailor marketing, and provide customer support.

Opting out

You can unsubscribe at any time by replying STOP to a marketing message. We may send one confirmation message after you opt out. For help, reply HELP or contact us. We may still send non-marketing messages about an order or service where permitted by law.
